B) PERSONAL DATA SUBJECT TO PROCESSING<\/h3>

Through our website, the following personal data of Users may be collected and processed by the Controller (as well as by any Processors):<\/p>

Common personal data<\/strong> of the User, necessary to enable identification, management of requests and possible provision of services or purchases: name and surname, email address, telephone number, billing and shipping address, tax data where necessary, data relating to orders or reservations, as well as any additional data voluntarily provided by the User for assistance, information or communications with the Controller.<\/p>

Information relating to credit cards or other payment instruments used by the User to make payment will not be processed directly by the Controller, but by the authorized payment service provider, through specific and secure protocols. For more information on how such data is processed, the User is invited to consult the privacy policy of the selected payment service provider.<\/p>

For the purposes of booking, special categories of data<\/strong> may be collected: data concerning health, relating to allergies or food intolerances, as well as additional data connected to particular dietary regimes followed by the User.<\/p>

C) PURPOSES, LEGAL BASIS AND MANDATORY OR OPTIONAL NATURE OF PROCESSING<\/h3>

The purposes for which the data mentioned in the previous section are processed by the Controller are as follows:<\/p>

  1. Management of gift card purchase requests and orders placed through the website;<\/li>
  2. Management of reservation requests and related communications;<\/li>
  3. Compliance with obligations imposed by current legislation, including accounting, fiscal, administrative and public security provisions, where applicable;<\/li>
  4. Management of assistance or information requests transmitted by the User via email, telephone or other contact channels made available by the Controller;<\/li>
  5. Sending newsletters and promotional communications related to the Controller’s activities, with the User’s prior consent where required;<\/li>
  6. Processing of statistics and analysis on website usage, where based on personal or identifying data, with the User’s prior consent when required by applicable legislation.<\/li><\/ol>

    Legal Bases for data processing operations:<\/strong><\/h3>

    For purposes 1 and 2, the legal basis is the performance of a contract to which the User is a party or the performance of pre-contractual measures adopted at the User’s request, pursuant to article 6, paragraph 1, letter b) GDPR. Should special categories of data relating to health, such as allergies, food intolerances or particular dietary regimes, be processed, the legal basis shall be the explicit consent of the User, pursuant to article 9, paragraph 2, letter a) GDPR, in addition to the relevant legal basis under article 6 GDPR.<\/p>

    For the purpose indicated in point 3, the legal basis is compliance with legal obligations to which the Controller is subject, pursuant to article 6, paragraph 1, letter c) GDPR.<\/p>

    For the purpose indicated in point 4, the legal basis is the performance of pre-contractual measures adopted at the User’s request or, depending on the content of the request, the Controller’s legitimate interest in responding to received requests, pursuant to article 6, paragraph 1, letters b) and f) GDPR.<\/p>

    For purposes 5 and 6, the legal basis is the free, specific, informed and unambiguous consent of the User, pursuant to article 6, paragraph 1, letter a) GDPR. Consent is optional, distinct from other purposes and may be withdrawn at any time, without prejudicing the lawfulness of processing carried out before withdrawal.<\/p>

    For purposes 1 and 2, provision of data is necessary to conclude or perform the contract or to manage pre-contractual measures requested by the User; in the absence thereof, the Controller will not be able to provide the requested service or performance.<\/p>

    For the purpose indicated in point 3, provision of data is mandatory where required by applicable legislation; in the absence thereof, the Controller may not be able to fulfill legal obligations or properly complete the requested service.<\/p>

    For the purpose indicated in point 4, provision of data is optional; however, in the absence of necessary data, the Controller may not be able to respond to the User’s assistance or information request.<\/p>

    For purposes 5 and 6, provision of data and consent are optional: in the absence thereof, the User will not receive newsletters or promotional communications and the Controller will not carry out statistics or analysis based on non-anonymized personal data.<\/p>

    D) RECIPIENTS<\/h3>

    The data processed through this website, exclusively for the purposes indicated above, may be communicated to authorized processing subjects, providers of IT, management, administrative, accounting, fiscal, logistics, payment, marketing and assistance services, as well as to consultants and professionals, where necessary and within the limits of their respective purposes. Such subjects act, as applicable, as Data Processors, independent Controllers or authorized subjects.<\/p>

    Where provided for by applicable legislation, data may also be communicated to Public Authorities, Bodies or entities entitled to receive them, such as the competent Police Headquarters by territory and the Ministry of the Interior \u2013 Department of Public Security, only in the cases and limits provided by law.<\/p>

    E) TRANSFERS<\/h3>

    Personal data will not be transferred to third countries or international organizations, except where necessary for the use of suppliers or services located outside the European Economic Area. In such cases, the transfer shall take place in compliance with articles 44 et seq. GDPR, on the basis of adequacy decisions of the European Commission, standard contractual clauses or other appropriate safeguards provided for by GDPR.<\/p>

    F) DATA RETENTION<\/h3>

    Personal data collected or otherwise processed through this website shall be processed in compliance with the principles set forth in article 5 GDPR (lawfulness, fairness and transparency; purpose limitation; data minimization; accuracy; storage limitation; integrity and confidentiality; accountability) through paper or electronic means, exclusively for the pursuit of the purposes indicated above.<\/p>

    Personal data shall be retained for a period of time not exceeding that strictly necessary to achieve the stated purposes, unless further retention is required by current legislation or permitted by the Controller’s legitimate interest or for proven legal reasons.<\/p>

    In particular:<\/p>

    • For purposes 1 and 2, data shall be retained for the time necessary to execute the contract, as well as \u2013 on the basis of the Controller’s legitimate interest in possible legal defense \u2013 until the expiration of the limitation periods for any actions based on the contract.<\/p><\/li>

    • For the purpose indicated in point 3, data shall be retained for the time provided by current legislation, including applicable fiscal and civil law provisions; for example, accounting records and relevant documentation may be retained for 10 years pursuant to article 2220 of the Civil Code.<\/p><\/li>

    • For the purpose indicated in point 4, data shall be retained for the time necessary to manage and respond to the assistance or information request and, where necessary, for the further period allowed by applicable legislation to protect the Controller’s rights.<\/p><\/li>

    • For purposes 5 and 6, data shall be retained until withdrawal of consent or, if earlier, until achievement of the specific purpose for which they were collected, without prejudice to any further period necessary to document consent management or the request.<\/p><\/li><\/ul>

      Once the retention period has expired, personal data shall be deleted or anonymized in a manner that prevents re-identification of the User. The computer systems used for managing the collected data are configured, to the extent possible, to minimize data use when not necessary to achieve the pursued purpose.<\/p>
